Welcome to Law of Fengshui. These Terms of Service (“Terms”) govern your access to and use of the lawoffengshui.com website and the Law of Fengshui web application (collectively, the “Service”) operated by Law of Fengshui (“we,” “us,” or “our”).

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.


1. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.


2. Description of Service

Law of Fengshui provides a web-based platform for feng shui analysis and floor planning. Our Service includes:

  • Floor Planning Tools: Create and edit 2D and 3D floor plans
  • Feng Shui Analysis: Apply traditional feng shui principles to analyze spaces, including Ba Gua compass overlays, energy flow visualization, and directional analysis
  • Project Management: Save, organize, and manage multiple property analysis projects
  • Furniture Placement: Design room layouts with furniture and feng shui items

The Service is designed as an educational and planning tool to help users understand and apply feng shui principles to their spaces.


3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

3.3 Age Requirements

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you meet this age requirement.


4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Any content you upload or create using the Service must not:

  • Be defamatory, obscene, offensive, or otherwise objectionable
  • Infringe on any third party’s intellectual property or privacy rights
  • Contain any material that could give rise to civil or criminal liability

5. User Content and Intellectual Property

You retain ownership of all content you create or upload to the Service, including floor plans, project data, and designs (“User Content”). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your User Content solely as necessary to provide the Service to you.

The Service, including its original content, features, functionality, design, text, graphics, logos, and software, is owned by Law of Fengshui and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

5.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.


6. Important Disclaimers

6.1 Feng Shui Disclaimer

THE FENG SHUI ANALYSIS AND RECOMMENDATIONS PROVIDED BY THE SERVICE ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. Feng shui is an ancient practice based on traditional Chinese principles regarding the arrangement of space and energy flow.

We make no claims, representations, or warranties that:

  • Following feng shui recommendations will result in any specific outcomes
  • The feng shui analysis provided is scientifically validated
  • The Service can predict or guarantee improvements to health, wealth, relationships, or any other aspect of life

The Service should not be used as a substitute for professional advice from architects, interior designers, real estate professionals, or other qualified experts. Any decisions you make based on the feng shui analysis provided are made at your own risk and discretion.

6.2 Service Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAW OF FENGSHUI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, or goodwill
  • Service interruption or computer damage
  • The cost of substitute services
  • Any damages resulting from your use of or inability to use the Service
  • Any damages resulting from decisions made based on feng shui analysis provided by the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.


8. Indemnification

You agree to indemnify, defend, and hold harmless Law of Fengshui and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any User Content you submit or create through the Service
  • Any decisions or actions you take based on feng shui analysis provided by the Service

9. Subscription and Payment

9.1 Free and Paid Features

The Service may offer both free and paid features. Access to certain features may require a paid subscription.

9.2 Payment Terms

If you purchase a subscription:

  • You agree to pay all applicable fees as described at the time of purchase
  • Fees are non-refundable except as required by law or as expressly stated in these Terms
  • We reserve the right to change our pricing with reasonable notice

9.3 Automatic Renewal

Subscriptions may automatically renew unless you cancel before the renewal date. You can manage your subscription through your account settings.


10. Termination

10.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us at info@lawoffengshui.com.

10.2 Termination by Us

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms or our policies
  • Is harmful to other users, us, or third parties
  • Is fraudulent or illegal

10.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and User Content
  • Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability

11. Modifications to Service and Terms

11.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

11.2 Terms Modifications

We may revise these Terms from time to time. The most current version will always be posted on our website with the “Last Updated” date. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.


12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through the following process:

  1. Informal Resolution: We encourage you to contact us first at info@lawoffengshui.com to attempt to resolve any dispute informally.
  2. Binding Arbitration: If informal resolution is unsuccessful, any dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator’s decision shall be final and binding.
  3. Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

12.3 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.


13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Law of Fengshui regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

13.5 Notices

We may provide notices to you via email, posting on the Service, or other reasonable means. You may provide notices to us at info@lawoffengshui.com.
